1. Acceptance of Terms

By accessing our website, booking services, or receiving deliverables, you agree to these Terms of Service. If you do not agree, please do not use our website or services.

2. Services

  • Nova Coast Media provides photography, videography, and related media services.
  • Service details, pricing, and turnaround times are communicated in proposals, contracts, or booking forms.
  • We reserve the right to modify or discontinue services at any time.

3. Bookings & Payments

  • A deposit or full payment may be required to confirm bookings.
  • Deposits are generally non-refundable unless otherwise agreed in writing.
  • Final balances are due as specified in your invoice or contract.
  • Late payments may result in delays in delivery or additional fees.

4. Cancellations & Rescheduling

  • Client cancellations must be made in writing.
  • Deposits may be forfeited if cancellation occurs after booking confirmation.
  • Rescheduling is subject to availability and may require additional fees.
  • Nova Coast Media reserves the right to reschedule due to illness, emergencies, weather, or circumstances beyond our control.

5. Copyright & Usage Rights

  • All photos, videos, and media created by Nova Coast Media are protected by copyright law.
  • Nova Coast Media retains full copyright ownership unless otherwise agreed in writing.
  • Clients receive a license for personal or business use as specified in their contract (e.g., MLS listings, marketing materials).
  • Clients may not sell, alter, or transfer media without written permission.
  • Nova Coast Media reserves the right to use selected works in our portfolio, website, advertising, and social media, unless a written release is signed stating otherwise.

6. Client Responsibilities

  • Clients must provide accurate information for bookings, including access instructions, schedules, and project requirements.
  • Clients are responsible for ensuring property readiness (clean, staged, accessible) before the scheduled shoot.
  • Delays caused by the client may result in additional fees.
  • Model/Property Release Responsibility: Clients are responsible for obtaining all necessary permissions, releases, or consents from property owners, tenants, and individuals appearing in photos or videos. Nova Coast Media is not liable for claims related to unauthorized use of likenesses or properties.

7. Delivery

  • Media will be delivered digitally via email, cloud storage, or client portal.
  • Standard turnaround times are communicated in advance but may vary.
  • We are not responsible for delays caused by technical failures, third-party services, or events beyond our control.
  • Revisions & Edits Policy: One round of minor revisions is included at no extra cost. Additional revisions or major edits may incur additional fees at our standard hourly rate.
  • Archival & File Storage: Client files are stored for 2 months after delivery. After this period, files may be deleted without notice. Long-term archival is the client’s responsibility unless otherwise agreed.

8. Liability

  • Nova Coast Media is not liable for indirect, incidental, or consequential damages resulting from use of our services.
  • Our liability for direct damages is limited to the amount paid for the specific service.
  • We are not responsible for accidents, injuries, or damages occurring at client locations or while on assignment, unless caused by gross negligence.
  • Indemnification: Clients agree to indemnify, defend, and hold harmless Nova Coast Media, its employees, and contractors from any claims, damages, or expenses arising from the client’s use of media or failure to obtain proper releases.

9. Force Majeure

Nova Coast Media is not responsible for failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, government restrictions, strikes, power outages, pandemics, or other force majeure events.

10. Third-Party Links & Services

Our website or communications may contain links to third-party websites. We are not responsible for their content, practices, or services.

11. Termination

We reserve the right to refuse or terminate services at our discretion if a client violates these Terms, behaves abusively, or fails to meet payment obligations.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflicts of law. Any disputes will be handled in state or federal courts located in Los Angeles County, California.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with any signed proposals or contracts, represent the complete agreement between Nova Coast Media and the client, superseding any prior discussions or communications.

15. Changes to Terms

Nova Coast Media may update these Terms from time to time. Updated Terms will be posted on this page with the revised “Last Updated” date.
